By accessing or using any Pingverse product or service ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services. The Services are operated by Pingverse ( "we," "us," or "our").

2. Eligibility

You must be at least 13 years old to use our Services. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Account Registration

To use certain Services, you must create an account. You agree to provide accurate, current, and complete information, and to update it as necessary. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

4. Permitted Use

You may use our Services only for lawful purposes and in accordance with these Terms. You agree not to:

5. Communications & Anti-Spam

You agree not to use Pingverse to send unsolicited messages, spam, or bulk communications. Automated messaging is prohibited without prior authorization. Violations may result in immediate account termination.

Pingverse sends transactional SMS messages only, including verification codes and security alerts. We do not send promotional or marketing SMS. You may opt out of SMS messages at any time by replying STOP.

6. Carrier Limitations

SMS delivery is subject to carrier network availability and filtering. We cannot guarantee delivery to all phone numbers or carriers. International SMS availability varies by country. PSTN voice calling quality and availability depend on carrier infrastructure and may vary by region.

7. Products and Services

Pingverse offers multiple products including Connect (communication), Books (accounting), Portfolio (investments), Atlas (IDE), and Console (terminal). Each product may have additional terms specific to its functionality. By using a specific product, you agree to any applicable product-specific terms.

8. Payments and Subscriptions

Certain Services require payment. All payments are processed through Stripe. By making a purchase, you agree to Stripe's terms of service. Subscription charges recur until cancelled. You may cancel your subscription at any time through your account settings or by contacting support.

Refunds are handled on a case-by-case basis. Contact support@pingverseAI.com for refund requests.

9. Intellectual Property

All content, features, and functionality of our Services are owned by Pingverse and are protected by intellectual property laws. "Pingverse" and the Pingverse logo are trademarks of Clema Investments LLC.

You retain ownership of content you create or upload through our Services. By using our Services, you grant us a limited license to process, store, and transmit your content as necessary to operate the Services.

10. Disclaimer of Warranties

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our Services will be uninterrupted, secure, or error-free.

11. Limitation of Liability

To the maximum extent permitted by law, Pingverse shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Services.

12. Termination

We may suspend or terminate your access to our Services at any time for violation of these Terms or for any other reason at our discretion. You may terminate your account at any time by contacting us.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through our Services or by email. Continued use of our Services after changes constitutes acceptance of the updated Terms.

These Terms shall be governed by the laws of the State of New York, without regard to its conflict of law provisions.
